These terms apply when you use Huntaway. “We” means [business name and NZBN], the business that runs Huntaway. “You” means the builder or business that uses it.
1. What Huntaway does
Huntaway helps you collect completion documents from your trades, checks them automatically, and puts them together into a pack for your Code Compliance Certificate (CCC) application. It can also draft replies to council requests for information (RFIs).
2. It assists. It does not certify
Huntaway does not certify, approve or guarantee that any building work, document or application complies with the Building Act 2004, the Building Code or any consent. The automatic checks can be wrong or incomplete. You are responsible for reviewing every document, every check and every draft before you rely on it or send it to a council. The people who sign each document stay responsible for it, and the council makes its own decision.
3. Your account
Keep your sign-in secure. You are responsible for what happens under your account, including links you send to trades.
4. Upload links
Each upload link lets anyone who has it see the site address and consent number, and upload a document for that one item. Only send links to the right person. If one link is used many times in an hour, extra uploads are saved but not checked automatically. If a link goes to the wrong person, remove the document from the job and add it again to make a new link.
5. Your documents
You own the documents you and your trades upload. You give us permission to store, process and copy them only so we can run Huntaway for you, including sending them to our service providers for the automatic checks. You confirm you are allowed to upload them and to share the information in them with us.
6. Fees
Fees are shown on our website in New Zealand dollars excluding GST, and are invoiced monthly. You can cancel at the end of any month. We will give you at least 30 days' notice before changing them.
7. Fair use
Don't use Huntaway to upload anything unlawful, to try to get around its security, or to overload it.
8. Availability
We work to keep Huntaway running and your data backed up, but we can't promise it will always be available or error free. Keep your own copy of each CCC pack.
9. Liability
To the extent the law allows, we are not liable for indirect loss, lost profit, or loss caused by a council decision, a delay, or a document or check that was wrong. Our total liability to you is limited to the fees you paid us in the 12 months before the claim. You use Huntaway for business purposes, so the Consumer Guarantees Act 1993 does not apply, and the parties agree it is fair and reasonable to contract out of sections 9, 12A and 13 of the Fair Trading Act 1986.
10. Ending
You can stop using Huntaway at any time. We can suspend or close an account that breaks these terms. When an account closes, you can download your CCC packs for 30 days before we delete your data.
11. Changes and law
We may update these terms and will tell you about important changes. New Zealand law applies and New Zealand courts decide any dispute.
